Terms of Use (EULA)

Please read these terms carefully before using Optaxia.

Agreement to Terms

By downloading, installing, or using the Optaxia mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Optaxia is a GPS photo tracking application that allows users to:

  • Capture photos with GPS location data
  • Track and store location coordinates
  • Sync photos to cloud storage services (Google Drive, OneDrive, Dropbox)
  • Organize and manage geotagged photos

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Subscriptions and Payments

Auto-Renewable Subscriptions

  • Subscription Plans: Optaxia offers auto-renewable subscription plans (monthly/annual) that provide access to premium features.
  • Payment: Payment will be charged to your account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Subscription Length: The subscription length (monthly or annual) and price will be clearly displayed at the time of purchase.
  • Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings in the App Store / Play Store after purchase.
  • Cancellation: You may cancel your subscription at any time through your App Store / Play Store account settings. Cancellation takes effect at the end of the current billing period.
  • No Refunds: No refunds will be provided for any partial subscription period, except as required by law.

User Data and Privacy

Data Collection

  • Location Data: The App collects GPS coordinates when you capture photos
  • Photos: Photos are stored locally and optionally synced to your chosen cloud services
  • Account Information: We collect your email address for authentication

Data Usage

  • All data is used solely for providing the App's functionality
  • We do not sell or share your personal data with third parties for marketing purposes

Cloud Storage

  • When you connect cloud storage services (Google Drive, OneDrive, Dropbox), you authorize the App to upload photos to your chosen service
  • You are responsible for managing your cloud storage accounts
  • We are not responsible for data loss due to cloud service issues

User Responsibilities

You agree to:

  • Provide accurate information when creating an account
  • Keep your account credentials secure
  • Use the App in compliance with all applicable laws
  • Not use the App for any illegal or unauthorized purpose
  • Not attempt to reverse engineer, modify, or hack the App
  • Respect intellectual property rights

Required Permissions

Location Services

The App requires access to your device's location services to function properly. You can control location permissions through your device settings.

Camera and Storage

The App requires camera access to capture photos and storage access to save photos locally. You control these permissions through your device settings.

Intellectual Property

  • The App and all its content are owned by Optaxia and protected by copyright and trademark laws
  • You may not copy, modify, distribute, or create derivative works of the App
  • All trademarks and logos are property of their respective owners

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
  • The App is provided "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not responsible for data loss, even if due to App malfunction
  • Our total liability shall not exceed the amount you paid for the subscription in the past 12 months

Third-Party Services

  • The App integrates with third-party cloud services (Google Drive, OneDrive, Dropbox)
  • We are not responsible for the performance, availability, or policies of third-party services
  • Your use of third-party services is governed by their respective terms

Changes to Terms

  • We reserve the right to modify these Terms at any time
  • Changes will be posted in the App with an updated "Last Updated" date
  • Continued use of the App after changes constitutes acceptance of the new Terms
  • We will notify users of material changes via in-app notification or email

Termination

  • We may suspend or terminate your access to the App at any time for violation of these Terms
  • You may stop using the App and delete your account at any time
  • Upon termination, your right to use the App ceases immediately
  • Provisions regarding intellectual property, liability, and dispute resolution survive termination

Governing Law

  • These Terms are governed by the laws of the State of United Kingdom
  • Disputes shall be resolved in the courts of the State of United Kingdom

Age Requirements

  • You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App
  • Users under 18 must have parental consent

Apple's Licensed Application End User License Agreement (EULA)

This App is licensed, not sold. Your use of the App is also governed by Apple's Licensed Application End User License Agreement (EULA), which can be found here: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall take precedence.

Additional Terms:
  • No Warranty: Apple has no warranty obligation with respect to the App
  • Product Claims: We, not Apple, are responsible for addressing any claims relating to the App
  • Intellectual Property Claims: We, not Apple, are responsible for any third-party intellectual property infringement claims
  • Support and Maintenance: We, not Apple, are responsible for providing support and maintenance for the App
  • Apple's Role: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Optaxia regarding the use of the App.
